This agreement between: BioCycle NZ Limited, Registered Office 463 Devon Street East, New Plymouth, hereafter called the Company

and:

hereafter called the Customer, for the maintenance of the BioCycle Aerobic Wastewater Treatment System installed at:

which shall operate under the following terms and conditions.

1. At frequency of no less than ______ times per year, at approximately evenly spread intervals, the accredited personnel shall inspect the System and carry out the following programmed maintenance:
• Check and, where necessary, adjust the aeration system.
• Clean out the inside of the irrigation pump chamber.
• Check and, if necessary, clean (or replace at the owners expense) the irrigation filter and air blow filter.
• Check and test the air blow filter, irrigation pump and electrical system including alarm where accessible.
• Check on the condition of the liquid in the chambers of the tank and, if considered necessary, test the water quality for turbidity and pH levels.
• Flush the irrigation discharge lines and replace (at the owners expense) any visible missing, clogged or defective drippers or sprayheads.
• Monitor the usage of disinfection tablets if applicable, and (at the owners expense) replenish the supply.
• Provide a written report to the Owner and the Owners local terrotorial authority.
2. In the event of the alarm warning being activated, the owner must notify the accredited provider (phone 0800 BIOCYCLE (246 292)) as soon as practible and within 72 hours of alarm notification. The authorised installer/servicing personnel, undertakes to respond within 24 hours of the notification.
3. If the Owner requests the Company to carry out work to the System other than specified in Clause 1 above or that covered by the guaranteed then the Owner will pay the accredited provider's reasonable charges for such work and any necessary materials. Also the Customer shall pay the accredited provider's reasonable charges for work done and materials supplied pursuant to Clause 1 above where the need for such work and materials results from the Owners failure to ensure compliance with any reasonable operating instructions, suggestions or recommendations given by the Company (or its authorised agents) or from neglect of wilfully damaging actions of any person, or from the System being required to bear a workload which is inteferring with the System in any way, or from the Owner's failure to comply with this agreement.
4. An account (including any reasonable charges for additional work as detailed in Clause 3) will be provided to the Owner following work (as detailed in Clause 3) will be provided to the Owner following each service and it's payable within 7 days from the date of invoice. The company reserves the right to charge penalty interest on overdue accounts, at the rate of 5% over and above the advertised overdraft rate charged by the Company's bank at the time, for the date on which payment should have been made, up to and including the date on which payment is made.
5. This contract is effective from ________________, the date the System was installed, or 3 months from installation, which ever is the earliest date, and remains in force while there is a commisioned BioCycle Aerated Wastewater Treatment System on the property.

Failure to comply with the maintenance agreement will void all warranties.
